Our client, a distinguished firm with a leading property litigation team, boasts one of the largest teams in the country. They have been involved in some of the most intricate and high-profile cases in recent years, spanning the High Court, Court of Appeal and Supreme Court. This team, located within the real estate group, collaborates with one of the largest real estate practices nationwide, serving a diverse clientele, including house-builders, pension funds, property companies, developers and telecoms operators. Recognised in the top tiers for Birmingham and London, they also attract stand-alone clients seeking specialised assistance with complex or high-value disputes.
Guided by esteemed leaders and Partners, our client's team operates seamlessly between Birmingham and London offices, functioning as a unified team to deliver a comprehensive litigation and dispute resolution service to clients in the real estate sector. They offer advice and representation across various legal forums, including Court proceedings, arbitrations, adjudications and mediations. For those inclined towards advocacy, they encourage and support qualification, providing in-house advocates where needed.

About the role
As a leading recruitment agency, we are seeking candidates for a significant role within a prominent property litigation team based in Birmingham. The role involves substantial independent responsibility, managing a significant caseload either independently or in collaboration with a Partner. The candidate will be advising and overseeing all stages of the litigation process, from initiation to trial, with direct client engagement. The role also includes supervision of Junior Lawyers and collaboration with other professionals such as Surveyors and advocates. The caseload encompasses diverse issues, including but not limited to:

  • Development-related matters like rights to light, vacant possession strategies and nuisance claims
  • Contract disputes involving land, including pre-conditions, breach and overage disputes
  • Professional negligence issues arising from real estate transactions
  • Landlord and tenant issues, particularly business tenancies, including asset management for clients with extensive portfolios
  • Clearing off or enforcing rights on freehold land, such as easements or restrictive covenants
  • 1954 Act renewals
  • Forfeiture and possession claims
  • Dilapidations
  • Rent/service charge issues
  • Rent reviews
  • Insolvency issues impacting real estate/leases


Additionally, there is an opportunity to specialise in esoteric areas such as mines and minerals disputes, rights of light issues, telecoms matters and disputes for living sector clients.


About you
As a Property Litigator, candidates should possess experience and enthusiasm for contentious litigation and a deep understanding of clients and transactions in the real estate sector. We are seeking someone who:

  • Has 6+ years PQE, preferably with experience in development disputes
  • Is a team player
  • Demonstrates strong technical legal skills
  • Is practical and commercially minded
  • Exhibits flexibility, positivity and the ability to manage a heavy caseload
  • Has strong interpersonal skills with a passion for developing Junior Lawyers
  • Can manage their own caseload and supervise Junior Fee Earners
